Do I need a fresh BOC-3 for reinstatement?

It depends on the cause of revocation and the elapsed time. If the original BOC-3 lapsed (caused or contributed to revocation), a fresh BOC-3 is required as part of reinstatement. If the original BOC-3 is still on file in SAFER and the underlying registered process-agent provider remains in good standing, the existing designation may be sufficient. Most reinstatement applications include a fresh BOC-3 as a defensive measure even when the original is technically still valid.

The 49 CFR §366.4 process-agent designation is part of the federal qualification stack for active operating authority. For reinstatement, FMCSA verifies that the §366.4 obligation is currently met — either by the original BOC-3 still being on file with a current registered provider, or by a fresh BOC-3 filed during the reinstatement process. Either path satisfies §366.4 for reinstatement purposes.

For revocations where the original BOC-3 lapsed (the registered provider lost BOC-91 standing, or the carrier's legal name changed making the prior designation obsolete), a fresh BOC-3 is mandatory as part of reinstatement. The fresh BOC-3 is filed through a registered process-agent provider with current BOC-91 standing; the filing typically completes within 24 hours and the SAFER reflection follows.

For revocations where the original BOC-3 is still technically valid (e.g., revocation caused by insurance lapse with the BOC-3 unaffected), the carrier could rely on the existing BOC-3. In practice, most carriers file a fresh BOC-3 anyway as part of the reinstatement package because the cost is low ($50-$75 with a flat-fee provider) and the defensive value is high — FMCSA review is more confident that all federal items are current when the BOC-3 is fresh and clearly attached to the reinstatement application.

Carriers using flat-fee BOC-3 providers can complete the BOC-3 component of reinstatement in 24 hours from intake. Annual-renewal BOC-3 providers may have longer turnarounds depending on their internal queue. For time-sensitive reinstatement applications, carriers should coordinate the BOC-3 refile in parallel with the BMC-91 insurance reinstatement and the formal reinstatement application to avoid sequential delays.
